1. Scope
The general terms and conditions (hereinafter «GTC») apply to all orders placed and contracts concluded via the online shop of Planted Food AG, Kemptpark 32/34, Building 1244, 8310 Kemptthal, Switzerland (hereinafter «Planted» or «we»). We reserve the right to change the terms and conditions. The version of the terms and conditions valid at the time of the order, which cannot be unilaterally changed for this order, is decisive. -
2. Offer
The offer is aimed at natural persons resident or legal entities based in Switzerland or Liechtenstein (hereinafter referred to as "customers" or "you"). Deliveries are only made to addresses in Switzerland or Liechtenstein. The offer is valid as long as it is visible in the online shop and while stocks last. Price and product range changes are possible at any time. The illustrations shown in advertising, brochures, the online shop, etc. are for illustration purposes only and are not binding. The specific information on the product packaging is authoritative. -
3. Price
The prices are in Swiss Francs, incl. statutory value added tax (VAT). The price in the online shop at the time of the order is decisive. -
4. Payment variants

We accept the payment methods offered in our online shop.
2. Purchase on account
planted. may, at its own discretion, offer payment on account (with or without an installment payment option). We may make this payment method dependent on a positive credit check and other requirements determined at our discretion (e.g. minimum age, place of residence). You are not entitled to payment on account or payment in installments. For the purpose of a credit check, personal data is recorded and passed on to the company commissioned with the credit check. When paying by invoice, planted. can assign the purchase price claim to the company displayed in the online shop, if applicable. Payment processing is carried out by this company and you will receive the invoice directly to the e-mail address provided. In the event of late payment, default interest and processing fees will be charged. In the event of late payment, planted. is not obliged to accept new orders or fulfill outstanding deliveries. planted. reserves the right to charge reminder fees and default interest. All expenses incurred in connection with the collection of overdue debts shall be borne by the customer. In the event of unsuccessful reminders, the invoice amounts can be assigned to a company commissioned with the collection. The company commissioned with the collection will assert the outstanding amounts in its own name and for its own account and may charge additional processing fees and default interest from the due date. -
5. Order
The presentation of the products in the online shop is not a legally binding offer, but a non-binding invitation to customers to order the product in the online shop. After submitting the order, you will automatically receive an acknowledgement of receipt documenting that the order has been received by Planted. You can only add to or cancel the order until it is processed in one of our logistics centers. If an order is supplemented, the original order serves as the basis for calculation, whereas any special offers and discounts at the time of the supplement are not taken into account. Planted is free to reject orders in whole or in part without stating reasons. In this case, you will be informed and payments already made will be refunded. Further claims are excluded, in particular there will be no subsequent delivery of the products that cannot be delivered. Temporarily unavailable products cannot be pre-ordered. -
6. Conclusion of contract
The contract is only concluded when the order is processed in Planted's logistics center. As soon as the order is ready for dispatch, you will receive an order confirmation by e-mail. -
7. Delivery times

Your delivery address must be in Switzerland or the Principality of Liechtenstein.
2. Delivery times
It is not possible to specify an exact delivery time within the delivery period. Deviations in time and the blocking of a specific delivery date are possible, especially on peak days with exceptionally high delivery volumes, whereby any claims for damages and other claims by you are excluded. Orders are shipped from Monday to Thursday; there is no shipping from Friday to Sunday. There are no deliveries on Sundays and official national or cantonal holidays. If you are not at the delivery address at the time of delivery and have not given any special delivery instructions, the delivery person may leave the delivery in a freely accessible location or leave a collection invitation in the mailbox. If you have received a collection invitation, you must collect the delivery from the relevant post office within 48 hours. You assume responsibility for the delivered products, even if they were not directly received by you.
3. Delivery costs
The delivery costs depend on the value of the products ordered (minimum order value excluding delivery costs, deposits and credit notes). The delivery costs communicated in the online shop apply. The delivery costs are listed as an additional item in the shopping cart and on the invoice.

8. Warranty
Planted guarantees that the food is free from defects until the expiry date, subject to the following conditions, which you must prove:
• Chilled food must be unpacked immediately after receipt and stored at a maximum of 2-5° Celsius.
• Frozen products must be handled properly and stored after delivery at a continuous temperature of at least -18° Celsius.
Planted can provide the warranty at its discretion by partial or full replacement with an equivalent product, credit up to a maximum of the sale price at the time of the order, or reduction. In the event of a credit, the amount paid by you for the defective goods will be credited to the customer account. Planted reserves the right to request proof of the defect, e.g. by means of a photo.
There is no general right to return products that are free of defects and have been delivered correctly. Mandatory statutory provisions remain reserved in each case. -
9. Notice of defects
If products are delivered with obvious damage to the packaging or contents, you should immediately file a claim with the service provider (e.g., carrier, post office) and refuse acceptance, without prejudice to your warranty rights. Ask the service provider (e.g. carrier, post office) to provide you with a damage confirmation report. You must also report all transport damage to Planted immediately.
Furthermore, it is your responsibility to check the ordered products immediately upon receipt and to store them correctly (in particular refrigerated or frozen, see section 8). For any defects or deviations from the order, you must notify Planted's customer service on the day of delivery by e-mail to [email protected]. After that, only hidden defects can be claimed, which must be reported to the customer service immediately after discovery. -
10. Loyalty program
After creating a user account, you can collect loyalty points when ordering products. Planted may exclude the earning of points for the order of certain products. The collected points can be used to purchase certain products (rewards). Participation in the loyalty program is voluntary. Planted reserves the right to make changes to the loyalty program at any time or to terminate the program. -
11. Data protection
Planted also provides information on how it processes personal data in its privacy policy. -
12. Disclaimer
Planted excludes its liability to the extent permitted by law. -
13. Applicable court and place of jurisdiction
The legal relationship between Planted and the customer is subject to Swiss substantive law. The place of jurisdiction for natural persons is Zurich or the customer's place of residence. The exclusive place of jurisdiction for legal entities is Zurich.
